• Services: Refers to the VPS and dedicated server hosting services provided by PureVPS.
• Customer: Any individual or entity that uses PureVPS services.
• Account: The customer-specific account created for accessing our services.

3. Eligibility

To use our services, you must be at least 18 years old and capable of entering into a legally binding agreement. By using our services, you represent and warrant that you meet these requirements.

4. Account Registration and Management

Account Information

You agree to provide accurate and complete information during registration and to update such information to keep it current.

Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use of your account.

5. Use of Services

Acceptable Use

You agree not to use our services for any unlawful purposes, including but not limited to:

• Disseminating harmful or illegal content.
• Engaging in activities that infringe on intellectual property rights.
• Conducting or promoting illegal activities, including actions that violate the laws of the country where our services are hosted.
• Utilizing our services for mining cryptocurrencies.
• Utilizing our services for providing commercial VPN services.

Resource Usage

You must use the resources allocated to your account responsibly. Excessive use that disrupts the stability of our services may result in suspension or termination of your account.

6. Service Level Agreement (SLA)

We strive to provide a high level of service availability and guarantee a monthly uptime of 99.95% for all VPS/VDS and dedicated server services. If the availability falls below this threshold, you may request compensation in the form of service credits as specified below:

• 99.0% – 99.95%: Credit of 10% of your monthly service fee.
• 95.0% – 98.99%: Credit of 25% of your monthly service fee.
• Below 95.0%: Credit of 50% of your monthly service fee.

To claim compensation, please contact our support within 30 days of the incident.

7. Payment and Billing

Fees

You agree to pay all fees associated with the services as outlined on our website.

Billing Cycle

Billing occurs on a monthly basis unless otherwise specified.

Late Payments

Failure to pay invoices on time may result in suspension or termination of services.

8. Termination and Suspension

By Customer

You may terminate your account at any time by providing written notice to us.

By PureVPS

We reserve the right to suspend or terminate your account for violations of these ToS or any other policies.

Data Retention

Upon termination, your data may be deleted. It is your responsibility to back up your data prior to termination.

9. Limitation of Liability

To the fullest extent permitted by law, PureVPS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

10. Indemnification

You agree to indemnify and hold harmless PureVPS, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, liabilities, and expenses arising from your use of the services or violation of these ToS.

11. Changes to Terms

We may modify these ToS at any time. We will notify you of significant changes by posting the new terms on our website. Your continued use of the services after such changes constitutes your acceptance of the new ToS.

12. Governing Law

These ToS are governed by the laws of Great Britain. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Great Britain.
